Welcome to Squishy Melt. These Terms of Service ("Terms") explain the terms on which we sell products to you through our website squishymelt.com. Please read these Terms carefully before placing an order. By using our website or placing an order, you agree to be bound by these Terms.

Squishy Melt is operated by Gummyment, MB, company code 307484838, registered at J. Savickio g. 4-7, LT-01108 Vilnius, Lithuania ("we", "us", "our").

These Terms apply to customers in the United Kingdom and do not affect your statutory rights under UK consumer law.

1. USE OF OUR WEBSITE

You may use our website for lawful purposes only.

To place an order, you must be aged 18 or older, or have the consent of a parent or legal guardian.

You agree to provide accurate, complete, and up-to-date information when placing an order, including your name, email address, and delivery address.

2. PRODUCTS

We make every effort to display our products as accurately as possible, including their colours, shapes, sizes, and descriptions.

Many of our squishy toys are made from soft foam, silicone, or similar materials and may be partly finished by hand. As a result:

- Colours may vary slightly from the photos due to lighting, photography, and your screen settings
- Shapes, sizes, and printed details may vary slightly from product to product
- Some products may have a light scent or a mild material smell when first unpacked, which usually fades over time

Minor variations of this kind are a normal characteristic of these products and are not considered a fault. This does not affect your rights if a product is faulty, damaged, or not as described.

All products are subject to availability. If a product you ordered is unavailable, we will let you know and offer you a full refund or, where possible, a suitable alternative.

3. PRODUCT SAFETY

Our products are toys and are intended to be used as described.

- Not suitable for children under 3 years. Small parts. Choking hazard
- Adult supervision is recommended for young children
- Do not bite, chew, or put products in the mouth
- Keep products away from heat sources, open flames, and direct sunlight
- Do not pull, stretch, or tear products beyond normal squeezing
- Stop using a product if it becomes torn, cracked, or broken, and dispose of any loose pieces safely

Please read any warnings on the product packaging before use.

4. PRICES AND PAYMENT

All prices on our website are shown in British pounds (GBP) and include UK VAT.

For orders with a total value of £135 or less, UK VAT is charged at checkout and no further import VAT or customs charges should be payable on delivery.

For orders with a total value above £135, import VAT and any applicable customs duties may be charged by the delivery company or HM Revenue & Customs on delivery. Where this applies, you are responsible for paying these charges.

Payment must be made in full at checkout using one of the payment methods shown on our website. Payments are processed securely by our payment providers.

We reserve the right to change our prices at any time. Price changes will not affect orders that have already been confirmed.

If we discover an obvious pricing error on an order, we will contact you before dispatch and give you the option to continue with the order at the correct price or cancel it for a full refund.

5. ORDERS AND CONTRACT

After you place an order, you will receive an email confirming that we have received it. This does not mean your order has been accepted.

A contract between you and us is formed when we send you an email confirming that your order has been dispatched.

We may refuse or cancel an order before dispatch, for example if a product is unavailable, if there is a pricing error, if we are unable to deliver to your address, or if we suspect fraudulent activity. If we cancel your order, we will refund any payment you have made in full.

6. SHIPPING AND DELIVERY

Our products are shipped from China.

Shipping is free on all orders.

Estimated delivery time is 7 to 15 business days from dispatch. Delivery times are estimates only and may be affected by customs checks, carrier delays, public holidays, or other events outside our control.

Once your order has been dispatched, we will send you tracking information where available.

Please make sure your delivery address is correct. We are not responsible for delays or non-delivery caused by an incorrect or incomplete address provided by you.

The products will be your responsibility from the time they are delivered to the address you provided.

If your order has not arrived within a reasonable time after the estimated delivery period, please contact us through our Contact Us page and we will investigate. If an order is confirmed lost in transit, we will send a replacement or issue a full refund.

7. RETURNS, REFUNDS, AND CANCELLATIONS

Returns, refunds, exchanges, and order cancellations are governed by our Return and Refund Policy, which forms part of these Terms.

You have 30 days from delivery to request a return, and you also have a statutory right to cancel within 14 days of delivery under UK consumer law. Please see our Return and Refund Policy for full details.

8. PRODUCT REVIEWS

You may leave reviews, ratings, photos, or other content about our products on our website ("Reviews").

By submitting a Review, you confirm that:

- It reflects your honest opinion and genuine experience with the product
- It is accurate and does not contain false or misleading information
- It does not contain offensive, abusive, discriminatory, or unlawful content
- It does not contain personal data of other people or infringe anyone else's rights
- Any photos you submit were taken by you or you have permission to use them

By submitting a Review, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce it on our website and marketing channels, including social media, in connection with our products.

We do not publish fake reviews, and we do not offer incentives in exchange for positive reviews. We may remove any Review that breaches these Terms. We do not remove Reviews simply because they are negative.

9. INTELLECTUAL PROPERTY

All content on our website, including text, images, logos, graphics, product descriptions, and design, is owned by us or used with permission, and is protected by intellectual property laws.

You may not copy, reproduce, distribute, or use any content from our website for commercial purposes without our prior written permission.

- Breach of your statutory rights in relation to the products, including the right to receive goods that are as described, of satisfactory quality, and fit for purpose
- Defective products under the Consumer Protection Act 1987

We only supply products for domestic and private use. We are not liable to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We are not responsible for damage caused by misuse of the products, failure to follow product safety warnings, or normal wear and tear.

Our website may contain links to third-party websites or use third-party services, such as payment providers and delivery companies. We are not responsible for the content, policies, or practices of third-party websites or services.

13. PRIVACY

14. EVENTS OUTSIDE OUR CONTROL

We are not responsible for delays or failure to perform our obligations caused by events outside our reasonable control, such as natural disasters, severe weather, strikes, transport disruption, customs delays, pandemics, or government actions.

If such an event affects your order, we will contact you as soon as possible. If there is a significant delay, you may cancel your order and receive a full refund for any products you have paid for but not received.

15. CHANGES TO THESE TERMS

We may update these Terms from time to time. Any changes will be posted on this page with an updated "Last updated" date.

The Terms that apply to your order are the Terms in force at the time you placed it.

16. GOVERNING LAW

These Terms are governed by the laws of England and Wales. You may bring legal proceedings in respect of these Terms in the courts of England and Wales. If you live in Scotland, you may bring proceedings in either the Scottish or English courts. If you live in Northern Ireland, you may bring proceedings in either the Northern Irish or English courts.

Nothing in these Terms affects your statutory rights as a consumer.
